Osinbajo may be impeached as acting President over Magu – report

Human rights activist and lawyer Mike Ozekhome has said Acting President Yemi Osinbajo risks impeachment over his retention of Ibrahim Magu as the Acting Chairman of the Economic and Financial Crimes Commission, EFCC.

Ozekhome explained that the continuous retention of Magu as the Chairman of EFCC was an impeachable offence which was provided for in the constitution.

In a statement he signed and issued on Tuesday, the constitutional lawyer said, “For the Acting President to continue to retain Magu in office as acting chairman amounts to “gross misconduct” as defined by Sections 143 of the 1999 Constitution.

“This is because a deliberate breach of the Constitution or violation of extant laws is an impeachable offence.

“The provisions of Section 2 (3) of the EFCC (Establishment) Act, 2004, are all too very clear and straightforward to admit of any ambiguity.

“They simply provide that the President shall appoint the EFCC chairman subject to confirmation by the Senate. This simply means the EFCC chairman cannot act in office without approval by the senate.

“It becomes patently illegal and unconstitutional for Magu to continue to be brazenly retained in office, in spite of the hallowed doctrine of separation of powers and of checks and balances provided for in sections 4,5,6 of the 1999 Constitution and as ably espoused by Baron Dr Montesqueu in 1748.

“Resolutions of the Senate, and indeed the NASS are weighty and have the force of law under sections 4,88 and 89 of the 1999.”

He noted that what the executive is simply saying is “to hell with the Senate; you don’t matter or count for anything.”

He added, “That is intolerable. A rejection of any presidential appointment by Senate is final and puts an end to the tenure or aspiration of such an appointee.

“There ceases to be any acting capacity. That has been the custom, convention and provision of Article 2 section 2 of the USA Constitution since 1789 when the first presidential refusal occurred.

“Our presidential Constitution and presidentialism are modelled after the US’s experience. Have u ever heard of “Acting Minister” or “Acting Ambassador” when Senate rejects nominees to those positions? Let us for God’s sake get things right.”

I don’t blame Chief Mike ozekhome, I expect to hear these kinds of comments from him, when he claimed to get 78 million or so from Fayose as legal fee and it’s a pending case with the EFCC, he has also profited himself defending treacherous politicians with his legal bravery, this Chief Gani Fawehinmi of blessed memory; never did, yet he claims to be a human right activist, hmmm!!!, I ones had regard and believed in him, I was at igbosere magistrate court when he defended Bar. Festus Keyamo in the suit instituted by the inspector general of police…, but time indeed has shown the “sodobe” in his personality, It’s because lawyers with many faces like this that all these politicians keep stealing and embezzling public funds because they will always buy them to defend their them, yet, people like that won’t work for EFCC,even when they’re contacted, that’s the agency keep loosing big cases which would have brought sanity into this country, but posterity will judge them all and Nigeria will be liberated. Long live Nigeria!

  3. Mike Ozokhome is talking nonsense!Do we have “acting minister and or acting ambassador” in Nigeria now? He should always have it at the back of his mind, whenever he opens his wide mouth,that he is not talking to illiterates.

  4. The statements made by this man by name ozekhome clearly indicate that he is on enemy of the Buhari administration. I never knew he could open wide his month to commit such an egregious affront against the very innocent man oshinbajo who is committing himself to the unity and progress of our nation Nigeria. All the enemies of the Nigerian nation, most especially the sitting senators and ill-informed lawyer like ozekhomen will be exposed by God’s grace
