Former Edo deputy speaker sues police over alleged rights violation

A former deputy speaker of the Edo State House of Assembly, Fred Omogberale, has filed a suit at the Federal High Court in Benin against the Inspector-General of Police, Ibrahim Idris.


Omogberale is dragging the IGP to court over the alleged violation of his fundamental human rights to personal liberty, privacy and ownership of property.

Omogberale is praying the court for an order of perpetual injunction restraining the defendants from further harassing, arresting and torturing him at Afuze, Owan East Local Government Area of the state, and anywhere in Nigeria for no offence.

Other defendants in the suit are the Assistant Inspector General of Police in charge of Zone 5, Benin, the state Commissioner of Police and the officer in charge of the Anti-Robbery Squad, Benin.

The complainant also demanded a compensation of N100m from the IGP and other defendants for allegedly violating his rights on September 3 and 4, 2016, in contravention of sections 35, 37, 40, 41 and 47 of the 1999 Constitution, as amended.

The claimant, in an affidavit to back his claims, held that he was in his home at Ovbiomu-Emai when he received a phone call from his employees that some armed policemen allegedly stormed his filling station, Obviomu Petrol Station, at Afuze.

According to him, the police operatives, numbering about 22, came in two Hilux vans.

Omogberale also said that the manager of the petrol station, Daniel Igbafe, was allegedly handcuffed and tortured by the policemen.
